Assert your rights as an investor — before you need them

In 5 min you'll know: how to confirm an entity's (Portuguese securities market regulator) registration and demand full disclosure before investing

In Block 2, Lesson 8 you learnt to invest with your head. In Block 1, Lesson 9 you protected yourself against digital scams. Now we combine the two: investing requires not only knowing how to choose, but knowing how to defend yourself when something goes wrong. Your rights as an investor do not activate themselves — you must know them before you need them. The rule: before you invest, confirm that the entity is registered with the and that you have received all mandatory documentation.

Before you continue: investing wisely, you checked the intermediary's CMVM registration — but did you know you have investor rights beyond that?

(Answer in the next paragraph.)

The CMVM is your first line of defence. Any entity marketing financial instruments in Portugal must be registered with the CMVM — banks, brokerage firms, fund management companies, investment advisers. If it is not on the register, it is not authorised. The CMVM also publishes a map of financial intermediaries with their registrations and any sanctions. A "financial adviser" without a CMVM registration number is not an adviser — they are an unsupervised salesperson.

Costs are the silent killer of returns. Every fund has an annual management fee, subscription and redemption fees, and custody charges. A fund charging 2% per year in management takes 2% from your return — every year, compounded. Over 20 years, the difference between a fund at 2% and an ETF at 0.2% can amount to more than 30% of accumulated capital. Always request the FINE before subscribing to any product — it is mandatory and shows all costs.

Finfluencers and complex products are the two new frontiers of risk. A finfluencer who recommends cryptocurrencies or funds without presenting the risks is not informing — they are promoting. Complex products (certificates, structured products, derivatives) have payoffs that most investors cannot calculate mentally. If you cannot explain how the product generates a return in 30 seconds, it is not suitable for you. The CMVM has issued recurring warnings about these types of products and promoters.

Confirm your intermediary’s CMVM registration (30 seconds)

Your promise: This fortnight, I will confirm that every entity I've invested with is CMVM-registered and that I received the mandatory documentation.
